1. Who these terms apply to

These terms are an agreement between you (“you”, “customer”) and Derin’s Pot (“we”, “us”, “our”), a Lagos-based personal-shopping service operating in Nigeria.

By messaging us on WhatsApp, placing an order, or using any part of our service (web, app, or otherwise), you agree to be bound by these terms and our Privacy Policy. If you don’t agree, please don’t use the service.

2. What we do

Derin’s Pot is a personal market-shopping service. You tell us what you need (vegetables, proteins, provisions, imported brands). A real human walks the market — Mile 12, Oyingbo, Daleko, Ikota, Balogun — buys your items, sends you a photo before pack, and delivers same-day in Lagos or via freight to a diaspora address.

What we’re not

  • We are not a supermarket. We do not warehouse inventory.
  • We are not a logistics company. Diaspora freight uses third-party shippers.
  • We are not a financial institution. Payments are processed by Paystack and other licensed providers.

3. Placing an order

You can place an order through:

  • WhatsApp (the fastest, recommended channel)
  • Phone call / SMS to our line
  • The mobile app or web order form, when available

An order is confirmed only after we send you the basket photo and total, and you approve. Until then, we may decline or modify the order for any reason (out of season, unavailable, price spike, etc.).

4. Prices, fees & markups

We charge two things, transparently:

  1. The market price — what we actually paid that morning. We can show receipts on request.
  2. A flat shopper’s fee — currently ₦1,500 per order. This pays the shopper and covers the time spent walking the market.

Delivery is billed separately depending on your zone (intra-Lagos) or freight class (diaspora). The total is always quoted to you before you pay.

We do not mark up market prices. If a tomato basket costs ₦18,400 this morning, that is what you pay for it.

5. Payment

We accept:

  • Card payments via Paystack (Naira)
  • Bank transfer (Naira)
  • USSD
  • USD / GBP / CAD wire for diaspora orders

When you pay

First-time customers pay after delivery — open the basket, check everything, then pay. Returning customers may prepay if they prefer. The shopper’s fee may be collected at the start of a new shop for first-time diaspora customers.

Payment processing

Card payments are handled by Paystack. We do not store your full card details on our servers. By paying, you also accept Paystack’s terms.

6. Delivery

Same-day in Lagos

Orders confirmed before 11:00 WAT are eligible for same-day delivery. ETAs depend on your zone — typically 2–4 hours after pack confirmation.

Driver verification

Every driver carries a unique delivery code we share with you in WhatsApp. Verify the code before handing over payment. If the code doesn’t match, do not pay — message us immediately.

If you’re not home

We’ll attempt a second delivery the same day at your cost. After two failed attempts, the items become non-refundable for perishables.

7. Freshness & substitutions

We photograph your items at the market before pack. You approve via WhatsApp. If something looks wrong on arrival — wilted, the wrong item, missing — message us within 30 minutes of deliverywith a photo. We’ll either replace, partially refund, or credit your next order.

Substitutions happen when a specific brand or variety is unavailable. We’ll always ask first via WhatsApp. If you don’t reply within 30 minutes during shopping hours, we may make a reasonable substitution rather than leave the item out.

8. Cancellations & refunds

  • Before shopper leaves the market: full refund, no fee.
  • While shopping: shopper’s fee applies; perishables already purchased may be billable.
  • After pack: we’ll deliver as planned; refund only for items that arrive defective.

Refunds are issued to the original payment method within 5 business days, or as credit at your choice.

9. Diaspora orders

Diaspora orders ship to a Lagos address (for delivery to your family) or a freight address abroad. Freight ETAs vary by destination (24–72 hrs for air, 5+ days for sea). Customs duties and import taxes at the destination are the recipient’s responsibility unless we explicitly include them in your quote.

We cannot ship items prohibited in your destination country (e.g. fresh meat to certain jurisdictions). We’ll flag these before you pay.

10. WhatsApp usage

By messaging us, you consent to receive WhatsApp messages from Derin’s Pot, including transactional notifications (order status, photos, delivery ETAs) and occasional marketing (new in season, special bundles). You can opt out of marketing at any time by replying STOP or UNSUBSCRIBE.

We use the official WhatsApp Business API via Meta. WhatsApp’s own terms also apply to your use of the platform.

11. Your account

Your account is keyed to your phone number. You’re responsible for keeping it secure. Tell us immediately if you suspect unauthorised use.

12. Prohibited use

You agree not to:

  • Use the service to order items for resale at a markup without our written agreement
  • Misrepresent your delivery address or identity
  • Issue chargebacks for items you actually received and approved
  • Harass, threaten, or abuse our staff, shoppers, or drivers
  • Use automated scripts to flood our WhatsApp number with messages

We may suspend or block accounts that violate these rules. Persistent fraud will be reported to the appropriate authorities.

13. Liability

We are responsible for delivering the items you approved. We are not liable for:

  • Allergic reactions — please tell us about allergies before ordering
  • Delays caused by weather, road closures, fuel shortages, or other forces outside our control
  • Items you used incorrectly after delivery (e.g. food poisoning from improperly stored protein)

Our maximum liability for any single order is capped at the total amount you paid for that order.

14. Changes to these terms

We may update these terms. The “Last updated” date at the top reflects the most recent revision. Material changes will be announced via WhatsApp or email before they take effect.

15. Governing law

These terms are governed by the laws of the Federal Republic of Nigeria. Disputes will be resolved by negotiation first; failing that, in the courts of Lagos State.
